From: JoeBatutis@aol.com Subject: Hanna Barbera Date: 04 Jul 1995 08:09:01 -0400 Oringally From: JoeBatutis@aol.com There's a great new cd out of soundtracks to Hanna Barbera cartoons. Hanna Barbera Classics Vol. 1 has themes from Huckleberry Hound, Quick Draw McGraw, Magilla Gorrilla and Yogi Bear. There are almost 70 minutes of that wacky cartoon music (surprising, considering that this is from Rhino). Volume 2 will feature the Jetsons and Top Cat. Now if they'd only come out with a cd with George of the Jungle, Super Chicken and Tom Slick... oh how about those Sid and Marty Krofft shows- H.R. This is not due to a subscriber of the mailing list, or anyone on XMission. It is due to someone at BYU taking advantage of the openess of the mailing lists managed on XMission. They performed early cutting edge stuff with the use of tape delay, reverse echo by analog editting a cut and replaying the effect BEFORE the line,,, ( Page used this in "whole lot of love") There were stories back in the old days,,, that they were " instrumental :) " in redesigning the fender echo units and the meistro echo plex. In the " in space" recording they used a plate reverb on one track and a spring reverb on another ( more likey one amp was a twinreverb and the other a " non" reverb amp thus the studios plate system). They also began using very heavy wooden bodied MOSRITE guitars which allowed for a " radical" re-thinking of the tremelo bar. also by adgusting the double coil pickups on the mosrite they were getting split pickup effects which in essence doubled he pickup count from 2 to 4 and allowed the bridge pickup and the neck pickup to take on new sound qualities. The " floyd rose" and splitable humbuckers and active pickups are todays iteration of the ventures modified mosrite hardware and electronics. So My questions on amplification and anthology were purely based on how did they get the sounds and what cuts have i not heard. isn't that the purpose of this mailer? jim Steinway is the right way - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: dx@netcom.com (dx) Subject: Re: Hanna Barbera Date: 07 Jul 1995 05:41:47 -0700 Oringally From: dx@netcom.com (dx) Mark Gunderson... > Hey, there's also a great CD of sound effects out. Surf music at its best is atmospheric, emotional and over the top (not to mention drenched in reverb). These are some of my favorite qualities about Exotic or E-Z listenin' muzak. The Ventures are even more "exotic-esque" because of the Stereophonic Hi-Fi arrangement and production of albums like "Ventures in Space" and "Another Smash". I for one think that surf (and, again, the Ventures catalog especially) is perfectly reasonable fodder for the Exotica list. Space is pretty damn exotic. So is the ocean, for that matter. It was instrumental, and it sounded like a small group of mostly woodwinds. The arrangement was quiet, and sort of twisted - weird stacked chords. It struck me as sort of Weill-sounding. The credits seemed to indicate it was an Ellington arrangement and performance. I've heard that after playing the tune for years and years, he got sick of people requesting it and started doing bizarre arrangements - maybe this is one of those performances. It's on Liberty. No date given, but the 'other records by MD' list on the back lists lots of releases, so I guess it's either a late-vintage recording or a reissue. (I guess it could be a late issue of an early performance, too.) No personnel listed either. Tracks: Rain, Hilo March, Hawaiian Wedding Song, Volga Boatmen, Black Orchid, Pretty Maui Girl, Cockeyed Mayor of Kaunakakai, Lei Aloha Lei Makamae, On the Beach at Waikiki, Ol' Man River. After a couple of listens, I like it. Hilo March stands out. A couple of cuts are sort of forgettable, but the performances are good. Someone in the audience has a coughing fit in 'On the Beach'. I also picked up a lot of junk. "Twistin' in High Society" features twist versions of inappropriate songs. "Dick Kesner and his Magic Stradivarius plays Latin Favorites" is self-explanatory. In August, Olga will travel to Moscow from her home in Kiev, Ukraine. In Moscow, Olga will have a much easier and cost efficient means to place your personal romance ad throughout Russia. Last week I received the following from Olga: "I have already sent your ad to the papers in such towns: Moscow, St. Petersburg, Vladimir, Kazan. At nearest future I will send your ad to the paper in some more 12 towns of Russia, where papers are published. Some times (in winter, spring & now) I placed your ad in other papers, but they are not most popular paper in Moscow and some large cities of Russia. Besides, I am continuing to place your ad in papers of Ukraine. I promise to place your ad in some other papers when I will come to Moscow in August. I am glad that you have received fairly many letters from Russian & Ukrainian girls and I think you will received some more ones and will find your ideal in my country soon. I thank you very much ones more for your kindness & your help. My best wishes, Olga" This isn't a scam - call it panhandling if you want. . . I sent her $40 or $50 and I've received over 45 responses. Unlike placing romance ads in the U.S., women from the former USSR respond. Although one would guess the are doing so in the hopes of American citizenship, I haven't found it so. Olga lives in Kiev, Ukraine (population 3 million) and will travel to Moscow in August to visit her father. If you were to send a letter this week, she would receive it in time. The population of Moscow is 10 million - -- (3 times the size of Los Angeles.) Feel free to send a letter and ask her your questions. She will be happy to respond. Olga's address: Ukraine Kiev 253121 Dekabristov Street 5 - 178 Olga Kozmina I am posting anonymously because of the flames and volume of inquiries that would result otherwise. I think those who are truely interested will take the time to write. _____________________________________________________________________________ Although Olga has never seen a newsgroup nor heard of "net-etiquette," she believes that offering lonely singles the possibility of romance exceeds the cost of angering those who feel the net shouldn't be used in this fashion. Sorry this really isn't a direct reply to the post about Persuasive percussion. I'm actualy wondering how many there are in the series and if you are actually refering to the albums I'm thinking of... Are these the Command Stereo released albums like Persuasive and Provocative Percussion with the black and white covers by Joseph Albers? While I have never heard Russ Garcia or Al Caiola (I do plan to, when I can find their records) I do know and love Esquivel and John Barry and Martin Denny and some others you've brought up in the past. But why should Maestro Light and his Brigade be any different? Sure, there's a lot of schlock on that there Command Label (The Million Dollar Sound - the record where Enoch gathered as many Stradavarius et al violins together and had them play unison in the bathroom - or ANYTHING later than RS 900) but there are also many gems and command performances by Doc Severinsen, the aforementioned guitar virtuoso Tony Mottola, Dick Hyman's wild organ rides, and the Ray Charles Singers. Speaking of Tony Motolla, can anyone verify whether he is the same guy who is now the president of Sony USA and married to Mariah Carey? If he is that would explain a lot. Like why Johnny Mathis's album "One Fire, Two Guitars" was rereleased on the $30 gold Sony SuperBitMapped CD format. One of the Guitars on that album was Motolla. It was not actually one of Mathis's better outings (IMHO). Joey, Patrick, myself, and Sven ( my executive editor ) all contributed heavily to RJ's understanding of the scene. Joey and Pat hooked him up with Korla and we hooked him up with Oceanic Arts in Whittier and Gabe former art director of the Luau, Beverly Hills. RJ did all the work in earnest but I feel he didn't "properly" credit the younger generation As you know, Sven and I put out Tiki News and Joey does regular lounge shows and tours and Pat puts out LOUNGE L.A. and Sam Wick puts out Lounge magazine All of these are efforts that are inspired by the past but are entirely new and now. In fact my mag, Tiki News, does NOT cover music of the past, unless it is a substantial re-issue. I applaud RJ for his enthusiasm and effort in writing his piece I just feel that he took an unnecessary jab at current folks who create or recreate exotica And if you want to read more from Leslie Baxter you can check out the current and past issues of Hypno, the next issues of Hot Lava (free in LA & OC ), Tower Pulse!, et al. - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: dragster@interport.net (David Schafer) Subject: Re: new in the hood Date: 26 Jul 1995 08:22:34 -0400 Oringally From: dragster@interport.net (David Schafer) kling & klang, thanks for the info on dick hyman, he's got his hands on so many things. david - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: dx@netcom.com (dx) Subject: Re: LA Weekly Article Date: 26 Jul 1995 06:49:52 -0700 Oringally From: dx@netcom.com (dx) I already sent money for your Tki magazine - can you foward me info (addresses?) for the lounge 'zines you wrote of? - -dx - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: MARKG@mark-ed.infinet.com (Mark Gunderson) Subject: Columbus' Kahiki... Exotica DJing... Date: 26 Jul 1995 11:06:15 EST Yes, this always makes me feel fortunate to be a Columbus resident. Let me tell you, the Kahiki is unequalled... huge Tiki statues on the way on; an enormous banquet hall with exotic birds lining one wall (one long, long bird cage behind a glass panel), exotic fish on the other side. Flaming volcano drinks, strange drinks with dry ice in a skull mug (which you get to keep!)... just amazing stuff. Incidentily, I got the chance to DJ exotica music for the unwashed masses last Sunday! There's a new dance club that opened here -- it's one of those standard NY-style techno dance clubs, but a friend of mine put together a techno event and asked if I'd like to DJ a set of exotica in the chill-out room. I gladly accepted, and from midnight to 1am I churned out all the Enoch Light, Arthur Lyman, and Herb Alpert they could take. A few people actually tried to dance, most just sat and smiled, some laughed. It was a good experience, and one that I'm hoping I'll get the chance to repeat. It went better than I expected, even! Also, I can't recommend enough that you check out that WFMU catalog that whoever posted the URL for. I got my printed version in the mail and it has The Most Amazing things I've seen: everything from Esquivel to avant garde nude sousaphonists. From the flames coming out of the Tiki heads guarding the front door, to the two-story stone Tiki head fireplace, to the small Tiki heads in the bathrooms sinks (with water coming out of their mouths), it is a truly inspiring place. We found it the first time, driving through Columbus, looking for the original White Castle. After driving several miles down a wide road lined with churches, there it was! It's like the Church of Tiki. The roof is built in the shape of an inverted boat hull. They claimed (at the time) to be the only 4-star restaurant in the state of Ohio! Kelbo's was nice, the Tonga is good, Seattle's Tradewinds (RIP) had some real charm, the Zombie Hut had its moments... but none of them are even in the same league as the Kahiki. - -dx - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: OttovS@aol.com Subject: Re: LA Weekly Article Date: 26 Jul 1995 15:57:41 -0400 Oringally From: OttovS@aol.com >I already sent money for your Tki magazine - can you foward >me info >(addresses?) for the lounge 'zines you wrote of? I just ordered the two Esquivel disks from WFMU and yesterday picked up Les Baxter's Skins LP from the Salvation Army after hearing his name here... As an amateur keyboardist/composer/noisemaker and professional music fan, my tastes run from Mahler to Monk to the Butthole Surfers and I am always in search of new sounds... Since so much of the exotica genre is still new to me, I wondered if there might be anybody out there who would have a compilation or something that would expose me to some of these new sounds... I am particularly interested in learning more about the lounge scene... Any and all recommendations/directions/advice greatly appreciated... It sounds fresh every time I put it on. The best word I can think of to describe it is "whimsical." The arrangements are clean and precise in similarity to those on the Hunks "Little Rascals" release. If you enjoyed that and are into toon soundtracks, you won't be disappointed. I only wish more had been culled from "Delirium in Hi-Fi" (one track included here) which the excellent liner notes describe as so: "a project in which the possibilities of the recording technique of the day were stretched to their limits... I've seen the French "Voice of the Xtabay"/"Mambo"/"Legend of the Jivaro" 2-disc set and the compilation "The Spell of Yma Sumac" and then there's an Italian compilation--"Amor Indio," I think--which is just volume two of the French set ("Jivaro" and a few songs off "Mambo") with the songs out of sequence, plus two more tracks. (Humuhumunukunukuapua'a, are you reading this?) The album (also titled "Song For Anna") is on A&M Records, and (to my knowledge) has not been re-released on CD. For those who don't know, Ohta-san (a.k.a Herbert Ohta) is the premiere ukulele player in the world, taking the undersized and once-ridiculed Hawaiian instrument to new heights, performing Hawaiian, world, classical, jazz, and pop music. (Having only four strings with which to work has not been a limitation for him!) He has recorded dozens of solo albums: two on Decca; two on A&M; nine on the Surfside label in Hawaii; five on the Tropical Music label in Hawaii; and numerous other releases on smaller Hawaiian labels, both as a solo artist and a featured sideman. These titles, spanning over 30 years, parallel every "craze" in popular music, from the bossa nova in the 60's to disco in the 70's and beyond. Yet, nearly all of his titles have been available ONLY in Hawaii, and all are out-of-print, except for those that have been released in the last ten years. For info on how to receive current Ohta-san releases by mail order from Hawaii, drop me an E-mail. Or, if you're adventurous enough to audition cuts from Ohta's vinyl years, let me know and I'll put together a mix tape of these ukulele delights. BTW - For info on Hawaiian music in general, talk to me. I have one of the largest known collections of traditional Hawaiian music recorded both on the mainland and in Hawaii. They are really out of this world !:) I can't sell my show, since it is against station policy. I would lose my show and it is something that is very important to me. I don't know if you have been to the SPACE AGE BACHELOR PAD MUSIC WEB SITE with the ADJOINING ESQUIVEL WEB PAGE. If you haven then I'm sure you saw my listing for SPACE AGE POP-ON THE RADIO. Included in the tape label is the artst, the title of the tune and the original date of issue. They are extremely informative and sound exactly like what you are looking for. On 1 tape , for instance, there are approximately 40 different artists from 40 different LP's and cover every genre in this thing called space agre pop including very cool jazz from the 50's, beatnik jazz, private eye jazz, exotica, tape manipulations, MOOGS, ESQUIVEL, sounds of murder, mayhem & mystery fuzzy psych guitars/astro sounds/outer space exotica, WORD JAZZ by KEN NORDINE and more ! I charge $20.00 total and they are like nothing you have ever heard anywhere on the planet or elsewhere. They are really great for learning about AND HEARING many different artists & sounds which will help you tremendously on your start of your journey to the SPACE AGE. Does this sound like something that you would be interested in ? OR I also have a taping service where for $10.00 per LP, with a minimum of 2 LP's I will record (Nakamichi deck) ANY RECORD I HAVE. 99% of the music that I'm into is INSTRUMENTAL. First of all, selling copies of these recordings is illegal. I don't have much of a problem with trading live recordings, but this type of service takes money out of the artists pockets. I could see trading recordings, but charging $10.00 for each LP? Finally, it takes all of the fun out of the hobby. You don't get the cover art, which is often the best part of these LP's. You also don't get the thrill of finding "Quiet Village" in a thrift store for $.50, as someone posted earlier. This type of "business" seems to go against everything that is cool about the hobby of collecting exotica. If you must hear the music and can't find it anywhere, then trade for it, but don't spend $20.00 bucks on a 90 minute tape with 2 LPs on it. Here's what I picked up at a local shop for $7.55 (including tax) today. When you buy LP's from the thrift stores it really only benefits the store directly. They get your $0.50. However, when the demand for these albums becomes greater and greater (and the press catches on) then recording labels begin to reissue the recordings. The high demand for Esquivel, Martin Denny, and surf music led to the rereleasing of these recordings. These do directly benefit the original artists. I'm sure Denny and Esquivel are quite happy with the royalty checks they are receiving now. We simply should set the record straight on copyright infringement and consider every facet (pun intended, Jack) of the issue. Those who say it is highly unethical to "sell" the recordings, and better to simply "trade" them, do not have a complete understanding of copyright law. It is ILLEGAL to duplicate a copyrighted work (in any medium) and transfer the work to another party - PERIOD. Whether the copies are sold or traded is not an issue since, in either case, a potential sale is taken out of the artist's pocket. Should there be lines drawn over whether or not the original material is in- print, out-of-print, or never available at all as in the case of live "bootlegs?" Shouldn't matter. If material by an artist is out-of-print, selling or trading that material can detract from the sales of that artist's other in-print material. If the material to be traded is a bootleg of a live performance, then selling or trading that material will ALSO detract from the sales of that artists in-print material. Do any exceptions exist? Legally, no. Ethically, perhaps, at least for me! In the great big corporate world of supply/demand economics, marketing is KILLING the record/tape/CD/video buying public. The Disney empire is a grand example. "Buy Snow White now or risk never seeing it again." So, Disney builds up sales with the threat of a video becoming extinct. And you missed out and didn't get your copy in time. And it's illegal to swap or purchase a copy of it from a friend. Seems sort of unfair doesn't it? Why would Disney do such a thing? So that in ten years the Snow White "Limited Edition Boxed Set" complete with the original dress Snow White wore will be your only means of ever owning this "classic" again. And all for only $99.99. And you, of course, MUST HAVE IT! This is the evil of marketing in the world of art and artists. The same is true of a recording that simply isn't popular enough to be rereleased. Even if it's been out-of-print 15 or 20 years, copying it is illegal. Wouldn't it seem that, if it's STILL out-of-print, that the artist and the distributor don't care about what pittance they'll miss out on by not re-releasing the work? Probably true. But in the eyes of the law, it's illegal, for unlike the good old days of the 7 year copyright, in 1995, a copyright is FOREVER. Ever consider the video rental milieu with regards to copyright infringement? A video rental shop buys one copy of "Snow White" for $19.95, and can rent it to you night after night after night for $3.25 with no penalty? Somebody please tell me that the actors, actresses, and distributors are somehow getting residuals from these rentals besides the initial sale of the video to the rental store! Finally, what justifies it for me is the exclusivity behind a copyright. As an antique collector, I understand the disappointment of looking for one very particular piece for 8 or 10 years and never finding it. But when one finally gives up hope of ever finding it, there is nothing illegal about taking a picture of a coffee table to a craftsman and paying them to duplicate the table. Granted, the finished product is NOT an antique. Perhaps the value of having the actual antique is gone. Perhaps you don't have the liner notes and cover art. But you have a piece of furniture you will enjoy - personally - and the original artisan - now dead a mere 120 years - is none the wiser. Why shouldn't you be able to do such? So, now you know how one person feels about copyright infringement. Would I ask a friend to copy the latest Madonna album for me? Never. Would I ask Jack Diamond to record a long out-of-print Henry Mancini album for me? Almost definitely. Would I do the same for Jack? Indeed. And, when I at long last release my albums from my D.I.Y. studio, I don't doubt that some copies will be distributed "illegally." But, if that means that 500 more people hear my work because a friend gave them a copy, then perhaps those 500 people will like it enough to PURCHASE my next release. And so on, and so on...In short, there are pros and cons to copyright infringement for everyone involved - artists, distributors, and consumers alike. Try considering all sides of this issue. Remember, too, that humans draw fine lines over what is "legal" and "illegal" - none of which usually have anything to do with actual law, but more to do with personal ethics. (If you drive 56 mph in a 55 mph zone, you're breaking the law.) Simply consider carefully how important - relatively speaking - the whole copyright infringement issue is the scheme of world events. Consider who, if anyone, gets hurt by it, and in what way they may be hurt. And you'll be amazed that we're wasting time discussing this at all! Let those who can live with themselves for home taping continue to do so, and those who cannot simply won't. Now. Does anyone care to discuss exotic music? Actually, let me say it this way: If I absolutely _loved_ Madonna, I'd buy it new. If I marginally like her, I'd accept a copy, because I probably wouldn't buy it new anyway and she's making a killing already. I'd rather sink my money into smaller-release artists that need the money more, and I buy those things quite often. > ...Would I ask Jack > Diamond to record a long out-of-print Henry Mancini album for me? Almost > definitely. Would I do the same for Jack? Indeed. ... Yeah, but how much would you charge him? :-) Seriously, I've seen setups like this before; in fact, I even had something similar for a brief while. How would your feelings change if the charge for a taped album were... * $5? * $1? * A blank tape? * A tape trade? One friend of mine has a series called Amazing Thrift... all C-30's of selections from the thrift store. The cost? $1 a tape, and that includes postage. Obviously he's not making a red cent from this. Jack's scheme doesn't sit right with me because it sounds like money is his prime motivation, rather than the spirit of it (as is the case with Amazing Thrift). > ...And, when I at long last > release my albums from my D.I.Y. studio, I don't doubt that some copies will be > distributed "illegally." But, if that means that 500 more people hear my work > because a friend gave them a copy, then perhaps those 500 people will like it > enough to PURCHASE my next release. ... Exactly! I do put out my own stuff and have for many years. I tend to be anti-copyright myself, and my general policy is that I don't mind people copying my work as long as my contact information is included with the copy... that way people can get ahold of me if they want their own copy. I also try to make sure that the packaging is worthwhile, so those who pay actually get something besides just the music and a quick J-card insert. I think the policy works pretty well; I've just sold out of the first run (300) of my most recent tape, which is packaged in a hinged 8-track shell. One last issue that you didn't really expand upon -- not everyone can get everything equally. A good example for my region is Esquivel. I've been SCOURING thrift stores for probably about six years now. Do you know how many Esquivel records I've seen? NONE. Zero. Never even heard of the guy until Incredibly Strange Music, and all of a sudden he's the big shit. Presume for a moment that a CD reissue was never made of him... what's to be done? I would never be able to hear him unless someone like Jack or the Amazing Thrift project had something available. Yes, it's illegal, but at that point the illegality is moot -- the record company wouldn't sue for such a small operation; they're not pressing the records anymore so they're not losing money. Who's going to sue you? Certainly not the thrift stores... I'd say that at that point you've crossed from being an audio pirate to being a preservationist. - - Mark G. - -=-=- Mark Gunderson, Systems Analyst markg@mark-ed.infinet.com - -=-=- - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: Ken Freedman Subject: WFMU's URL already Date: 31 Jul 1995 12:42:48 -0400 (EDT) Oringally From: Ken Freedman OK, here's the poop on WFMU's Catalog of Curiosities. For Incredibly Strange Music Vol 2 we deliberately did not include cuts where we could not trace the owner (either for master rights or publishingl rights) because, being a commercial venture, we did not want to run the risk of being sued for infringment. Many of the artists on ISM Vol 2 are more than thankful for both the exposure AND the cash...Les Baxter, Rusty Warren and Ken Nordine to name three. And then there is their income from radio airplay as well The publishing income goes to the composers (either viai their designated publisher or, in some instances, directly). The royalties for master rights, in most cases goes to the record label that owns the recording...it is hoped that some of this income is passed on directly to the artist, depending on their individual agreements with said record label. Where possible, we informed the artists of the master rights agreement so that they could follow up with the record label for their respective share. We just paid out a five figure sum in royalties for the album. We are glad to be sharing our income with the artists that supplied the sounds. Do what you wish with tapes, just always be aware of where the money could have gone, and, if possible, compensate the respective party. Any tape sold for commercial gain requires a master rights license and a compulsory license for mechanical (publishing) rights. The ethical, moral and legal arguments are endless. Most of the music we are talking about is out-of-print. If someone buys a title from a thrift store, or if someone dubs an album on cassette, the artist gets no royalties. The Grateful Dead have thrived on a huge pirate live recording network. John Perry Barlow, a song writer for the Dead, has voiced this sentiment himself. If people like Jack spread hard to find music around (though he charges too much to do this effectively) he will probably help make this music popular again. If Jack promises only to dub out of print titles, then leave him alone, because he is genuinely helping the artists diseminate their music and helping people like us get access to it. I'd say that at that point > you've crossed from being an audio pirate to being a preservationist. And that's a big reason why some European countries (notably Italy) have 25 or 30 years as the sound copyright duration. /tp/ - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: MARKG@mark-ed.infinet.com (Mark Gunderson) Subject: Re: dyemund in the rough Date: 31 Jul 1995 12:40:44 EST Oringally From: MARKG@mark-ed.infinet.com (Mark Gunderson) ------------------------------------------------------------------------------- From: Lazlo Nibble : Subject: Re: dyemund in the rough Date: 31 Jul 1995 12:40:44 EST Laz, I'm curious about this law; haven't heard of it before... what does it say exactly? I always thought that it was alright to make a recording for yourself if you owned the original, but not for anyone else (regardless of money changing hands). Also, if you have any URLs for how I/we could read the legalese ourselves, that would be great. - - Mark G. - -=-=- Mark Gunderson, Systems Analyst markg@mark-ed.infinet.com - -=-=- - -- For help using the list software (sub/unsub, list users, etc.), email majordomo@xmission.com with HELP on a line by itself in the message. ------------------------------------------------------------------------------- From: "bill wynne" Subject: re: dyemund in the rough Date: 31 Jul 1995 13:07:16 EDT Oringally From: "bill wynne" Perhaps you're right! But my understanding (read "interpretation") of "noncommercial home recording" was that the recordings were to be for the owner's private use, i.e. to be added only to the source material owner's private collection. For example, if I own the new Esquivel CD, but want to tape it to play on my car cassette stereo, I understood that purpose to be acceptable under this Act. But I did not interpret it as being acceptable to tape the new Esquivel CD for my brother-in-law and two friends. Apologies if I unnerved anyone with my misinformation. And, if Lazlo is 100% right about this facet of the AHRA (and he probably is, as he's never lied to us before!), the Act has a serious flaw in it, IMHO. BTW - Although I may have misquoted the letter of the copyright law, I am still in favor of home recording. The source material I am seeking is Hawaiian recordings which will never see the light of day on CD. NEVER! Even when they were new releases, if a Hawaiian release sold 5,000 copies it was considered platinum. So, when I visit a fellow collector's home and find 10 or 12 titles I have been desperately seeking, LET THE TAPE ROLL! Who is really losing out in that situation? Lazlo - Thanks for saving me from 142 possible flames. "I am replying to this message at the risk of getting flamed, but this post really annoyed me. First of all, selling copies of these recordings is illegal. I don't have much of a problem with trading live recordings, but this type of service takes money out of the artists pockets." This is not a flame, but a simple argument. I find it extremely unethical when people choose to enforce copyright laws upon information that is no longer readily available for sale (out of print etc.). "Finally, it takes all of the fun out of the hobby. You don't get the cover art, which is often the best part of these LP's. You also don't get the thrill of finding "Quiet Village" in a thrift store for $.50, as someone posted earlier." Fun for you is not necessarily fun for others. I have made literally hundreds of thrift store voyages covering San Diego CA, Los Angeles CA, Tampa FL, New York NY, San Jose CA, Newark NJ, Rochester NY et al. For example, I have never found a single Yma Sumac album. Sure, it is easy to find Herb Alpert, Martin Denny, Ray Conniff, Percy Faith, and Burt Bacharach. But there are many many out-of-print albums that you may never find in a thrift store. Some of us care much much more about the music than the cover art, though cover art is a great diversion, and are willing to get the music in whatever form available. We buy eight track tape players such that we are ready when we find that Telly Savalas album on eight-track. Martin Denny is not obscure on this format either. By the way, I saw two of the ding-bat Tiki apartments on the Rosemead frontage road in Pico Rivera over the weekend: The Tiki and the Samoa. There are rooms for rent.
